All references to Brush Up on Stocks and Up on Stocks shall include the owner of Brush Up on Stocks, its editor and publisher, and any affiliates and employees of Brush Up on Stocks. Michael Brush is the editor and publisher of Brush Up on Stocks. All references to “you” and “your” shall mean the subscriber. Brush Up on Stocks and Up on Stocks are two names that refer to the same product, and they are used interchangeably here. All references to Up on Stocks shall include the products Brush Up on Stocks, Up on Dividends, Under $10 Stocks, Under $5 stocks and Pro.

Subscribing to and using Up on Stocks is expressly condition upon your assent to all of the terms and conditions of this agreement, to the exclusion of all other terms.

By subscribing to and by receiving Up on Stocks, you agree that have read and fully understand the terms and conditions set forth in this disclaimer, and the disclaimer published on the Up on Stocks website. By subscribing to and by using Up on Stocks, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not subscribe to or use Up on Stocks.

This Agreement is governed by the laws of the State of New York. If any provision of this Agreement is found to be unlawful, or for any reason unenforceable, that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. You agree that any disputes you have with Up on Stocks that cannot be resolved through discussion with Up on Stocks shall not be resolved in a court of law, but shall be resolved before an appropriate arbitration panel in the City of New York.

Up on Stocks is solely intended for use to individuals residing in the United States. Residents of other locations may subscribe to Up on Stocks, but Up on Stocks may not be appropriate for use in other locations.

Independent entity

Up on Stocks is a completely independent, stand alone entity. It is not associated with, affiliated with, or endorsed by, any of the other entities which employ Michael Brush, or any entities which employ any other employees of Up on Stocks. Up on Stocks and Michael Brush do not accept or receive payments from any of the companies discussed in Up on Stocks.

Trading disclosure

The publisher and editor of Up on Stocks may buy or sell the securities discussed in Up on Stocks for purposes of investment or trading without disclosure of all trades to subscribers. The publisher and editor of Up on Stocks may be long or short any securities discussed in Up on Stocks at any time, and those positions may change at any moment, depending on market conditions.

Subscription

Your subscription will continue and will renew automatically unless terminated by Up on Stocks or until you notify Up on Stocks of your decision to terminate your subscription. The appropriate annual, quarterly, or monthly fee for your subscription will be billed automatically at the beginning of each renewal period, to the credit card you designate, unless you cancel your subscription before the renewal period begins.

Up on Stocks reserves the right to charge the card given us by subscribers. Should the expiration date of the card change, Up on Stocks reserves the right to advance the date to your card’s new expiration.

You agree to pay all fees (including appropriate taxes) at the rates in effect at the time your subscription renews. You have 90 days from a billing date to question any discrepancies in your subscription renewal fee. After that, all charges will be deemed correct.

You may cancel your subscription inside your PayPal account or by notifying Up on Stocks if you are unable to do so. Monthly and quarterly subscriptions cannot be reimbursed or refunded. Annual subscriptions can be reimbursed by a pro rata amount for any full months remaining on your subscription, minus a $5 handling fee. You must notify Up on Stocks that you wish to cancel at least 48 hours before your subscription is up for renewal. You are responsible for knowing your renewal date.

Up on Stocks reserves the right to change subscription rates at any time. The new rates will apply when your subscription renews.

When you subscribe to Up on Stocks, you agree to provide accurate, current, and complete information about yourself on subscription forms, including your legal name, address and telephone number. You agree to update your information as needed to keep it current and complete. You agree not to share any contents of Up on Stocks with anyone who is not also a subscriber.

You represent and warrant to Up on Stocks that: you are over the age of eighteen and that you have the authority to enter into and perform your obligations under this agreement; that you shall comply with all the terms and conditions of this agreement without limitation; and that you have provided accurate and complete registration and subscription information.

Up on Stocks content is intended for your personal use only. You may not republish, post, transmit, share or distribute Up on Stocks content without prior written permission from Up on Stocks. Up on Stocks is the copyright owner of all Up on Stocks content except as otherwise indicated. Any redistribution of the contents of Up on Stocks without the written consent of the editor is strictly prohibited. You may not create derivative works from, or sell any content obtained from Up on Stocks.
